1. INTRODUCTION
These Terms and Conditions (“Legal Terms”) constitute a legally binding agreement between you (“you” or “User”), whether personally or on behalf of an entity, and RiaCab LLC (“RiaCab,” “Company,” “we,” “us,” or “our”), governing your access to and use of our website, mobile applications, and related services (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you must discontinue use of the Services immediately.
2. NATURE OF SERVICES (IMPORTANT)
RiaCab is a taxi network service provider. We provide technology and dispatch services that connect passengers with independently owned and operated, properly licensed taxi operators and their drivers.
RiaCab does not provide transportation services, does not own or operate vehicles, and does not employ drivers. RiaCab is not a Transportation Network Company (TNC) and does not operate under rideshare or TNC regulations.
All transportation services are provided solely by independent taxi operators, who are fully responsible for complying with all applicable federal, state, county, and municipal laws and regulations.
3. ELIGIBILITY AND USER REPRESENTATIONS
By using the Services, you represent and warrant that:
We reserve the right to suspend or terminate your access if any representation is false or violated.
4. ACCOUNT REGISTRATION
You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.
We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion.
5. BOOKINGS, PAYMENTS, AND FEES
Fare estimates are provided by independent taxi operators and may vary based on distance, time, traffic conditions, and local regulations.
RiaCab may facilitate payment processing but is not responsible for fare disputes, which must be resolved directly between you and the taxi operator.
6. NO EMPLOYMENT OR AGENCY RELATIONSHIP
Nothing in these Legal Terms creates an employment, partnership, joint venture, or agency relationship between RiaCab and any taxi operator, driver, or user.
7. USER CONDUCT AND PROHIBITED ACTIVITIES
You agree not to:

8. USER CONTRIBUTIONS AND FEEDBACK
The Services do not allow users to publicly post content. You may submit feedback, suggestions, or support requests.
By submitting feedback, you grant RiaCab a non-exclusive, royalty-free, perpetual license to use such feedback for any lawful purpose without compensation.
9. INTELLECTUAL PROPERTY RIGHTS
All content, software, trademarks, logos, and materials within the Services are owned by or licensed to RiaCab and are protected by U.S. and international intellectual property laws.
You are granted a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes only.
10. SERVICE AVAILABILITY
We do not guarantee uninterrupted availability of the Services. The Services may be modified, suspended, or discontinued at any time without notice.
11. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
RiaCab does not guarantee the conduct, safety, legality, or quality of any taxi operator or driver.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIACAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Our total liability shall not exceed the lesser of (a) amounts paid by you to RiaCab in the six (6) months preceding the claim, or (b) USD $100.
13. INDEMNIFICATION
You agree to indemnify and hold harmless RiaCab from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Legal Terms, or interactions with taxi operators.
14. TERMINATION
We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Legal Terms or applicable law.
15. GOVERNING LAW (NORTH CAROLINA)
These Legal Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
16. DISPUTE RESOLUTION
Any dispute arising out of or relating to these Legal Terms shall be resolved exclusively in the state or federal courts located within North Carolina. You consent to personal jurisdiction in such courts.
17. ELECTRONIC COMMUNICATIONS
You consent to receive electronic communications and agree that such communications satisfy legal writing requirements.
18. SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Legal Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect. These Legal Terms constitute the entire agreement between you and RiaCab.
